Terms of service

Effective 31 August 2026
Not reviewed by a lawyer

This document describes accurately what the software does with data, checked against the code rather than adapted from a template. That is the part a lawyer cannot write, and it is not a substitute for the part they can. No lawyer has reviewed this text. Do not rely on it in a contract until one has.

Details still to fill in

This deployment has not been configured with an operating entity, a contact address, a governing jurisdiction. Those appear as blanks below rather than being guessed at, because an invented address in a legal document is a worse problem than a missing one: it looks answered.

An agreement between you and the operator of Datum for the use of Datum. Written to be read.

1. What Datum does

Datum reads work you send it, drafts a reply or a priced quote, and holds it for a person to approve. It records what it did and what that was worth, in two totals: one counting only measured effects, one including modelled ones.

2. Nothing is sent without a person, unless you say otherwise

Every draft waits for approval by default. You can change that in Settings, per workflow. If you do, you are choosing to let the agent send without review, and you remain responsible for what it sends. The audit trail records which setting was in force for every run.

3. Quotes and prices

Every figure Datum produces is arithmetic over the price book you configure. No AI model sets a price. Datum refuses to quote scope it cannot price rather than guessing at it, and names the omission on the document.

You are responsible for the price book and for every quote you approve. Datum computes; you decide. If your rates are wrong, the quote will be confidently wrong, and checking that is your job.

4. Your data stays yours

You keep all rights in everything you put into Datum, including your price book and the enquiries you forward. the operator of Datum uses it only to run the service for you. It is not used to train any model, not sold, and not shared except with the sub-processors listed in the privacy page.

5. Availability

There is no uptime guarantee. This is a small service on ordinary cloud infrastructure. It is monitored, it is backed up off-site daily, and it will still be unavailable sometimes. If you need a contractual service level, ask before you buy rather than after.

6. Paying, during the pilot

Datum is currently free. There is no charge, no card, and no trial that begins charging when it ends. Nothing in this section obliges you to pay anything while the pilot is running.

If the operator of Datum starts charging, you will get at least 30 days' written notice and a price, before anything is owed. You may carry on or stop, and stopping costs nothing. Continuing to use Datum after that notice period is what would create an obligation to pay, and not before.

The plans on the pricing page are what it would cost afterwards. They are published now so the pilot is not a surprise with a bill at the end. None of them is active.

Because it is free, expect it to be early. Section 9 limits liability in the ordinary way, and during a pilot that limit is meaningful: you are paying nothing, so there is nothing to measure a refund against. A person approves every quote before it is sent, which is the default, and it is the reason a wrong draft costs you a click rather than a job.

6b. Paying, afterwards

Plans and prices are on the pricing page. Subscriptions bill monthly in advance through Stripe and you can cancel at any time, taking effect at the end of the period you have paid for. We do not refund part-months.

Going over your plan's run allowance does not stop your work. The overage is recorded and you are told. Refusing to process a real enquiry because a counter ticked over would cost you a job, which is a far worse outcome than us absorbing a few cents.

7. Fair use

Do not use Datum to send unsolicited bulk email, to impersonate anyone, or for anything unlawful. Do not attempt to reach another account's data. We may suspend an account doing any of these, and we will tell you why.

8. Ending it

You can delete your account at any time from Settings, which erases it and everything belonging to it. Export your data first if you want a copy; afterwards it is gone.

the operator of Datum may end an account for a breach of section 7, or on 30 days' notice for any other reason, with a refund of anything paid for a period not yet used.

9. Liability

Datum is provided as it is. To the extent the law allows, the operator of Datum's total liability is limited to the amount you paid in the twelve months before the claim.

Two things this cannot cover, said plainly rather than buried: a quote you approved and sent, and work you lost because the service was unavailable. A person approves every quote by default precisely so that the decision, and the responsibility for it, stays with someone who can judge it.

10. Changes

If these terms change in a way that matters, you will be told by email before it takes effect. The date at the top of this page changes only when the wording does.

11. Law

A governing jurisdiction has not been configured for this deployment. It must be set before these terms are used in a contract.

12. Contact

A contact address has not been configured for this deployment.
